Terms of Service
The rules of the road for using Swipe Again.
Effective date: October 1, 2026 · Version 2026-10-15 (last updated October 15, 2026)
These Terms of Service ("Terms") govern your use of Swipe Again, the failed-payment recovery service at swipeagain.com ("we", "us", "our", "Swipe Again"). By creating an account, starting a trial, or subscribing, you ("you", "merchant") agree to these Terms. If you do not agree, do not use the Service. If you sign up on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to that entity.
1. What Swipe Again does
Swipe Again is a recovery layer for subscription businesses. When a recurring payment fails on a platform you connect to Swipe Again, we work to collect it: decline-code-aware retry scheduling that coordinates with your processor's own retry activity so the same card is never worked by two schedules at once; branded recovery communications sent under your name by email and text message, and — for high-value recoveries — by voice call; hosted payment-update pages where your customers can fix their payment method; and cancel-deflection pages that present a save offer — a discount, a pause, or a service remedy — when a customer of yours starts to cancel. A dashboard reports your recovered revenue and recovery activity. On connect, we also review up to the prior 90 days of failed payments (Section 3.3).
You can connect any of these platforms: Stripe, Recharge, Seal Subscriptions, Skio, Loop Subscriptions, Chargebee, Recurly, Braintree, Paddle, and WooCommerce. If you sell through Shopify, you connect the payment or subscription platform that bills your Shopify customers — Shopify itself is the storefront, not a connected platform.
We are not a payment processor and we never hold your funds. All charges run through your existing processor and settle to your account exactly as before. We never see or store full card numbers.
Your account. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for the acts of anyone you authorize to use your account. Keep your contact email current — notices under these Terms go there. Tell us promptly at support@swipeagain.com if you believe your account has been compromised.
2. Subscription, trial, and billing
- Plans and prices. $179 per month (billed monthly), or $1,799 per year (billed annually). Every plan includes every integration we currently offer, at no extra cost.
- 14-day free trial. New accounts receive a 14-day free trial. A valid card is required upfront to start the trial; you will not be charged during the trial.
- First charge. Billing begins automatically on day 15 unless you cancel before the trial ends. Monthly plans then renew each month; annual plans renew each year on the anniversary of the first charge.
- Taxes. Prices do not include sales, use, value-added, or similar taxes. Where we are required to collect them, they are added to your charges.
- If a payment fails. If a subscription charge fails, we may retry the payment method on file and will notify you by email. If it remains unpaid, we may suspend the Service — including recovery activity — until it is paid, and may terminate under Section 13.
- Cancellation. Cancel anytime — no call, no maze. Cancel in two clicks from your account's billing page, or email support@swipeagain.com. Cancellation takes effect at the end of the current billing period; the Service remains active until then. Section 13 explains how your data is handled when your subscription ends, including how to request an export.
- Refunds. Paid subscription months are non-refundable and we do not offer pro-rated refunds for partial months, except as required by law or under the guarantee in Section 3.
- Price changes. We may change prices with at least 30 days' notice by email. Changes apply from your next renewal; you may cancel before then to avoid them. Your current billing period is never repriced mid-term.
3. Recovery measurement and the guarantee
The guarantee in Section 3.1 is the only recovery promise in these Terms. It is measured on Recovered Revenue, defined in Section 3.2, and the figures we present in your dashboard, reports, and digests follow this Section 3.
3.1 The guarantee
Your subscription begins with a 14-day free trial. If Recovered Revenue (as defined in Section 3.2) during your Guarantee Window is less than $179, the next month of your subscription is free, as described in this Section 3.1.
Guarantee Window. Your Guarantee Window is the 30 consecutive calendar days beginning on the later of (a) the first day of your first paid billing period — the day your free trial ends and your first subscription charge is made — and (b) the date you first connect a platform to your Swipe Again account; if you have not connected a platform, your Guarantee Window begins on the first day of your first paid billing period. Days preceding your first platform connection are not included in the Guarantee Window, and the free-trial period is not part of the Guarantee Window.
How it's measured. Recovered Revenue collected during the Guarantee Window counts toward the $179 threshold whenever the original failure occurred, including failures identified through the connection backfill described in Section 3.3. Recoveries collected during your free trial appear in your dashboard and reports but do not count toward the guarantee threshold. Measurement follows Section 3.2 in all respects, including its netting rule for refunds and reversals, and your processor's records govern in the event of any discrepancy.
Determination and remedy. No claim is required. We determine the result promptly after your Guarantee Window ends and notify you by email. Applying the free month involves a processing period of 3–5 days and takes effect on the next billing cycle after processing completes. In the standard timeline — you connect during your trial, so your Guarantee Window is your first paid month and ends on your second billing date — your second month's charge proceeds as scheduled and the free month is your third month of service, for which no charge is made.
Annual plans. If you subscribe on an annual plan, the remedy is a credit equal to one-twelfth of the annual fee you paid, applied automatically to your next invoice after the same determination and processing period described above.
Conditions. The guarantee applies to every paid subscription, and no platform connection is required. If no platform is connected during the Guarantee Window, Recovered Revenue for the Guarantee Window is $0, which is below the $179 threshold, and the free month (or annual credit) applies on the same terms as any other shortfall. The free month (or annual credit) applies only if your subscription has not been cancelled before the remedy is applied. The guarantee applies once, to your first Guarantee Window only.
3.2 Definitions
- "Failed Payment"
- A subscription payment attempted on a platform connected to your Swipe Again account ("Connected Platform") that was not collected — for example, a declined, expired, or otherwise unsuccessful charge.
- "Recovered" and "Recovered Revenue"
- A Failed Payment is Recovered when its amount is subsequently collected while your account is connected and the Service is active — by whatever mechanism the collection occurs, wherever it happens, and whoever prompted it. "Recovered Revenue" is the total dollar amount of all Recovered payments in a period.
- How amounts are measured
- Amounts are measured by the amount actually collected, not the amount originally billed; a partial collection counts at the amount collected. If a collected payment is refunded or reversed (including by chargeback) during the same measurement period in which it was counted, it is deducted from that period; a refund or reversal after a period's guarantee determination has been made does not reopen that determination. Your processor's and Connected Platforms' records are the authoritative source for whether and when a payment failed and was collected. Your Swipe Again dashboard, reports, and digests present those records; if there is any discrepancy, the processor's and Connected Platforms' records govern. These definitions apply to every guarantee determination made under these Terms.
3.3 The connection backfill
When you connect a platform, Swipe Again reviews up to the prior 90 days of Failed Payments and takes recoverable ones into its recovery flows (the "backfill"). A backfill payment that is collected while your account is connected and the Service is active is Recovered Revenue under Section 3.2 and counts toward the guarantee if collected during your Guarantee Window.
3.4 Figures are informational
Recovery figures, rates, and breakdowns shown in your dashboard, reports, digests, or emails — including any breakdown of how recoveries occurred — are informational measurements provided for your reference. They are not guarantees, warranties, or promises of future results. The only recovery promise in these Terms is the guarantee in Section 3.1, on the basis stated in this Section 3.
3.5 Changes to this Section 3
If we change this Section 3, the change applies to Guarantee Windows that begin after the change takes effect. A Guarantee Window already in progress is determined under the version of this Section 3 in force on the date that window began.
4. Your responsibilities
- You must have the legal right to authorize retries and charges against your customers' payment methods through your processor, and to send them recovery communications.
- You control the voice and content choices for recovery communications sent under your brand, on every channel — email, text message, and voice. You are responsible for having the consents and legal basis required to contact your customers on each channel, and for compliance with applicable law, including CAN-SPAM and CASL for email and the TCPA and messaging-carrier rules for text messages and calls, including honoring opt-outs. Our sequences apply opt-out and suppression handling, but the lawfulness of contacting your customers remains yours.
- You will provide accurate account information, keep your platform connections authorized while using the Service, and keep your contact email current.
5. Cancel flows
If you use Swipe Again's cancel-deflection pages for your own customers, you agree that: (a) a customer who chooses to cancel must always be able to complete the cancellation — the flow must not block, loop, or obscure completion; (b) the customer receives a clear confirmation when a cancellation completes; (c) you will not configure offers or prompts in a coercive or deceptive way; and (d) you will keep records of cancellation requests and completions as your own legal obligations require. We log cancel-flow sessions and outcomes in your dashboard.
6. Acceptable use
You will not: abuse, disrupt, or attempt to circumvent the Service; use it for unlawful purposes; resell or white-label it without our written agreement; misrepresent recovered-revenue data; or use recovery or cancel features to harass customers. We may suspend accounts that violate this section, with notice where practicable.
7. Data, privacy, and security
You grant us the rights necessary to process payment-failure metadata, customer contact details, and related subscription data on your behalf to provide the Service. We handle all data according to our Privacy Policy. You remain the data controller for your customers' information; we act as your processor/service provider.
You connect platforms through OAuth sign-in, API keys, or a plugin pairing key, depending on the platform. You may revoke a connection at any time in your settings; revoking a connection disconnects the platform and its stored credential is deleted promptly.
We protect data with encryption in transit and at rest, encrypted storage of connection credentials, and least-privilege internal access, as described in the Privacy Policy. We use a small number of service providers (subprocessors) — for hosting, data storage, and sending email and messages — under obligations to protect your data; the providers we use are identified in the Privacy Policy. Where applicable privacy law requires a data processing addendum, we will provide one on request.
8. Intellectual property, feedback, and confidentiality
The Service — including our software, retry logic, templates, and documentation — is owned by Swipe Again and its licensors and is licensed to you for your use during your subscription; it is not sold. Your data remains yours, as described in Section 7.
If you send us suggestions or feedback about the Service, we may use it without restriction or payment to you.
Each party will protect the other's non-public information that it receives under these Terms, use it only to perform under these Terms, and disclose it only to its personnel and service providers with a need to know. This does not apply to information that is or becomes public, was already known, or is independently developed.
9. Availability and third-party platforms
We work to keep Swipe Again reliable, but we do not guarantee uninterrupted availability. The Service depends on your Connected Platforms' and processors' APIs and services; their outages, changes, or restrictions may delay or limit recovery activity through no fault of ours. Retry scheduling in particular depends on your processor's APIs. Your fees are not conditioned on any particular platform integration remaining available.
10. Warranty disclaimer
Except for the guarantee in Section 3.1 — which is a billing remedy, not a warranty of results — the Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that any particular amount of revenue will be recovered.
11. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from these Terms or the Service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages — including revenue your processor failed to collect for reasons outside our control, or subscriber losses during processor outages. Nothing here limits liability that cannot be limited by law.
12. Indemnification
You will indemnify and hold us harmless from claims arising from your breach of these Terms, your recovery-communication content or your customers' claims about it, your cancel-flow configuration, or your lack of authorization to charge your customers.
13. Term and termination
These Terms apply from your first use of the Service until your subscription ends. Either party may terminate with notice; your cancellation under Section 2 is your notice. We may suspend or terminate accounts that violate these Terms, abuse the Service, or fail to pay.
When your subscription ends, platform connections are revoked and their stored credentials are deleted promptly, and recovery activity stops. You may request an export or deletion of your account data by emailing support@swipeagain.com; we complete deletion within 30 days of the request, except records we must retain by law (for example, billing records), consistent with the Privacy Policy. Sections 3 (for Guarantee Windows already begun), 7, 8, 10, 11, 12, 15, and 16 survive termination.
14. Changes to these Terms
We may update these Terms; material changes will be announced by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance. Section 3.5 governs changes to Section 3.
15. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in South Carolina, and you consent to their jurisdiction.
16. General provisions
If any provision is found unenforceable, the rest remain in effect. These Terms are the entire agreement between you and Swipe Again for the Service and supersede prior agreements on that subject. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of all or substantially all of our business, with notice to you. Neither party is liable for delay or failure caused by events beyond its reasonable control, except that payment obligations are not excused. A party's failure to enforce a provision is not a waiver of that provision or of any other. Headings are for convenience only. Notices to you go to your account email; notices to us go to support@swipeagain.com.
